Scottish land reform marching on, the sale may offer aspirants one of
their last chances to secure a personal coat of arms from the Lord
Lyon, Scotlands heraldic chief.

The buyer can call himself Baron of MacDonald and apply to Scotland's Lord Lyon King of Arms for a personal coat of arms. A baron's wife can use the courtesy title Lady MacDonald. Harold Brooks Baker, the director of Burkes Peerage, the genealogical bible of Britains ancient families, said that either barony could fetch upwards of £100,000. Mr Brooks Baker said: "Scottish titles are regarded as the caviare of titles around the world. "This is because, unlike English titles, those in Scotland are actually granted approval by the ruling monarch, that is to say the Queen. "Spain is the only other country in the world which grants titles approval by the monarch, so Scottish titles are very sought after indeed." The Ancient and Feudal Barony of Glenorchy, in Argyll, is expected to fetch the highest bid of the two Scottish titles. In the 15th century Glenorchy was part of the lands of Breadalbane of the Campbells of Glenorchy, and the Barony sale includes the island of Eilean na Feusaig. The island, which sits in the River Orchy, can be approached from land by a ford, and the owner has fishing rights on the waterway. The Lairdship, Superiority and Reputed Ancient Feudal Barony of Ascog on the Isle of Bute, also in Argyll, includes mineral rights as well as reversion and historic grant of foreshore and wrecks. The present owner of the title also holds the "Ascog Charter Chest", with its historic collection of Crown charters and ancient documents that directly relate to Ascog. Although not officially aristocrats, feudal baronies were among the middle ranks of the upper classes, and their powers are vested in a specified piece of land. Before the 1745 Jacobite rebellion, barons provided military service which, with no standing army, was essential to the maintenance of power and public order. At one time, barons had the power of life and death over those on their land, but over the years such privileges were eroded. In recent years the feudal powers have most effectively meant that a householder might need to secure the approval of the baron, as the feudal superior, when seeking planning permission if their property lies on the barons land. However, all that is set to change in November next year when the Abolition of Feudal Tenure Act comes into force, as part of the Scottish Parliament land reforms. Under this act, baronies will simply be titles of dignity, with no other powers or responsibilities. Barons will be able to sell their title without the land, and without the land being registered. The new owner of a barony currently has the right to secure a personal coat of arms from the Lord Lyon, Scotlands heraldic chief. Because a barony is vested in a piece of land, the Lord Lyon can establish if someone is a baron, and entitled to baronial arms, by checking the land register or the older sasine register. Once the act comes into force, such checks might not be possible, and the Lord Lyon is reconsidering whether he will be in a position to grant arms if he cannot establish whether an individual owns the baronial terrain. But those who purchase a baronial title now, may be lucky enough to secure a coat of arms before the new legislation comes into effect, Mr Brooks-Baker said that people buy titles for a variety of reasons. He said: "There was a Scottish Marquess whose younger brother wanted a title too, so we found him one - but it would be indiscreet to say who that was. "Many buyers are foreigners with an ancestral link to Scotland. "Its not about snobbery, its about history, and connecting with the past. Where would we all be if it were not for the people of the past?
